§ 120.31

Defense article

ITAR · Part 120 · Subpart C

Any item or technical data designated on the USML in Part 121, including technical data recorded or stored in any physical form, models, mockups or other items that reveal technical data directly relating to enumerated USML items. It also includes forgings, castings, and machined bodies that have reached a stage where they can be identified as a defense article. Software is treated as a defense article when described on the USML.

A part, component, accessory, or attachment is a defense article only if a USML paragraph describes it (often via “specially designed”).
Technical data is itself a defense article — that is why a deemed export of data is an export of a defense article.
