Designation of defense articles and defense services

ITAR · Part 120 · Subpart A

AECA §§ 38 and 47(7) require the President to designate defense articles and defense services. Those designations are the U.S. Munitions List in Part 121. Permanent import of many of the same articles is separately controlled by the Attorney General on the U.S. Munitions Import List (27 CFR part 447). Changes to the USML may be made only by amendment under AECA § 38.

Export/temporary import = State (ITAR). Permanent import = Justice/ATF (USMIL).
Designations are made with the concurrence of the Department of Defense.
