§ 121.1

The United States Munitions List

ITAR · Part 121

The operative list. Twenty-one categories, each built from enumerated paragraphs, notes, and (in most categories) a paragraph (x) for EAR items exported with a defense article on the same State license. A USML hit ends the classification; there is no “also check the CCL.” Changes are published in the Federal Register and are not effective until the amendment is in force.

  • Walk the category that matches the article’s general characteristics, then match an enumerated paragraph before any “specially designed” catch-all.
  • Notes are operative. Many Export Control Reform “moves” to Commerce are implemented as notes, not as deletions of the category title.
  • Category XXI is a DDTC residual designation for articles, technical data, and defense services not otherwise enumerated. It is not Category XVII (classified not-otherwise-enumerated) and it is not a self-classification dumping ground.
