§ 123.16

Exemptions of general applicability

ITAR · Part 123

The hardware-side general exemptions. Each paragraph is its own mini-license, with item, destination, nationality, value, and documentation limits. Registration is still required in most cases. Exemptions generally cannot be used for 126.1 destinations, for SME except as stated, or for classified articles. Cite the specific paragraph on the AES EEI and in records.

  • Read the paragraph you are citing. “123.16” is not an exemption; “123.16(b)(1)” (or whichever paragraph) is.
  • Most exemption failures are destination or nationality misses, not item misses.
  • FR 2026-19161: § 123.16(a) exemptions do not apply to § 126.1 destinations; exports requiring Congressional notification (§§ 123.15, 124.11); SME or MTCR Annex articles; or persons ineligible under § 120.16.
