§ 120.5

Relation to regulations of other agencies

ITAR · Part 120 · Subpart A

ITAR coexists with several other export and import regimes. Permanent imports of defense articles are ATF/USMIL (27 CFR 447). Dual-use and commercial items are EAR (15 CFR 730–774). Nuclear equipment and material may be NRC or DOE. OFAC sanctions and Commerce end-user lists can independently block a transaction even when ITAR would otherwise allow it. Always run the other-agency overlay after the USML/EAR classification.

  • The U.S. Munitions Import List is not identical to the USML. Do not assume an ITAR-controlled firearm is (or is not) ATF-controlled on import.
  • Encryption, space, and firearms are the most common dual-regime collisions.
