§ 120.1

General authorities

ITAR · Part 120 · Subpart A

Section 38 of the Arms Export Control Act (22 U.S.C. 2778) authorizes the President to control the export and import of defense articles and defense services. That authority is delegated to the Secretary of State by Executive Order 13637, and from the Secretary to the Deputy Assistant Secretary for Defense Trade Controls in PM/DDTC. This subchapter implements those authorities.

  • DDTC is the administering office; licenses, agreements, CJs, and registrations all flow through it.
  • ITAR is not the EAR. Dual-use and commercial items generally live in 15 CFR 730–774 unless they are on the USML.
