Cat. VIII

Aircraft and Related Articles

ITAR · Part 121 · § 121.1

Military aircraft, including selected UAVs/UAS, and specially designed parts, inlets, landing gear, and related articles. “Military aircraft” is defined by enumerated missions and design, not by paint. Many parts of civil derivatives are EAR 9A610/9A619; the USML retains the combat, special-mission, and low-observable core. See Category XIX for gas turbine engines.

  • Effective 2026-10-13: State IFR FR 2026-17660 (91 FR 55457, published 2026-08-28) excludes certain survivability-enhanced civil aircraft from USML VIII(a)(8). Aircraft Survivability Equipment (ASE) itself and related technical data and defense services remain ITAR. eCFR § 121.1 Category VIII displays the change from 2026-10-19. Definitions of ASE, Secured ASE, and Survivability-enhanced aircraft are in § 121.0. https://www.ecfr.gov/current/title-22/section-121.1 https://www.federalregister.gov/documents/2026/08/28/2026-17660/international-traffic-in-arms-regulations-modification-of-civil-aircraft-to-incorporate-aircraft
  • A USML part does not lose ITAR status because it is installed on a civil airframe (§ 120.11).
  • UAV endurance, payload, and autonomy paragraphs are where most classification fights happen.
