§ 129.2

Definitions

ITAR · Part 129

Defines broker and brokering activities: any action on behalf of another to facilitate the manufacture, export, permanent import, transfer, reexport, or retransfer of a U.S. or foreign defense article or defense service, regardless of origin. Actions include financing, insuring, transporting, and soliciting. Certain administrative, freight-forwarding, and U.S.-domestic activities are carved out. Origin of the article does not save you — foreign-origin USML-described articles can still be brokered for purposes of this part.

  • “On behalf of another” is the hinge. Selling your own manufactured article is Part 122/123; arranging someone else’s sale is Part 129.
