§ 127.1

Violations

ITAR · Part 127

It is a violation to export, reexport, retransfer, or temporarily import a defense article, or to furnish a defense service, without the required authorization; to violate the terms of a license, agreement, or exemption; to engage in brokering without Part 129 compliance; or to conspire, aid, or abet those acts. Attempts and causing an act to be done are included. A violation does not require a completed overseas shipment.

  • Deemed exports, oral disclosures, and cloud-access grants are fully capable of being “the” violation.
  • Exemption misuse is a violation, not a lesser-included paperwork event.
