§ 125.4

Exemptions of general applicability

ITAR · Part 125

The workhorse technical-data exemptions. Paragraph (b) enumerates specific authorizations — including data in furtherance of an approved agreement, data exported to the U.S. Government, copies of data previously authorized, and other listed cases. Each paragraph is its own instrument. None of them is “data to Canada” (see § 126.5) or “data to dual nationals” (see § 126.18) by itself.

  • Cite the (b) paragraph. “125.4” on an AES line or in a TAM is not a citation.
  • Previously-authorized data is not a license to export a derivative that contains new USML content.
  • FR 2026-19161: § 125.4(a) (except (b)(13)) does not apply to § 126.1 destinations or persons ineligible under § 120.16. The same rule rewrote (b)(10) introductory text (“Releases,” “full-time”) and inadvertently dropped (b)(10)(i)–(iii).
  • FR Doc. 2026-19404 (91 FR 60299, effective Sept. 23, 2026) is the provenance for § 125.4(b)(10)(i)–(iii): permanent U.S. abode; not a national of a § 126.1 country; written notice that further transfer to other foreign persons needs prior written DDTC approval. Live eCFR § 125.4 is the primary text. Navigational aid — not legal advice.
