§ 123.9

Country of ultimate destination and approval of reexports or retransfers

ITAR · Part 123

The license’s country of ultimate destination is a control, not a suggestion. Any reexport (to another country) or retransfer (new end-user or end-use in the same country) of a USML article or of technical data requires prior DDTC authorization unless the original license or an exemption already covers it. Foreign consignees must be written into this obligation.

  • This is the most common post-shipment violation in Blue Lantern findings.
  • A foreign aftermarket sale, a bank foreclosure, and a “we hired a local subcontractor” are all retransfers.
