§ 123.1

Requirement for export or temporary import licenses

ITAR · Part 123

The default rule: any export or temporary import of a defense article requires a license or other approval, unless an exemption applies. The applicant must be registered (§ 122.1) and eligible (§ 120.16). The license names parties, values, quantities, USML category, end-use, and end-user. An exemption is an affirmative defense, not the default.

  • Deemed exports of technical data are licensed under Part 125, not a DSP-5, unless they ride on an agreement.
  • Shipping EAR paragraph-(x) items on a DSP-5 does not convert them to ITAR.
