§ 122.1

Registration: requirements, exemptions, and purpose

ITAR · Part 122

Any U.S. person who engages in the United States in the business of manufacturing, exporting, or temporarily importing defense articles, or furnishing defense services, must register. The purpose is to give DDTC a known population of defense-trade actors. Exemptions exist for certain public officials, purely EAR manufacturers, and other narrow classes — they are not a university-wide carve-out. Manufacturing even one USML article in the United States triggers registration, whether or not it is exported.

  • “In the business of manufacturing” is broader than a production line — fabricating a USML part for a DoD contract counts.
  • Foreign persons do not Part-122-register; they appear as license parties, end-users, or (if brokering) under Part 129.
