§ 120.16

Eligibility for approvals

ITAR · Part 120 · Subpart B

A license or other approval will not be issued to a person who is ineligible — debarred under § 127.7, statutorily debarred after a criminal AECA conviction, or otherwise policy-ineligible (for example, a 126.1 party). Applicants must certify eligibility, and a conviction or debarment of a party, officer, or related person can freeze the whole docket.

  • Statutory debarment follows certain AECA/ITAR criminal convictions and is published in the Federal Register.
  • Administrative debarment is imposed after Part 128 proceedings or a consent agreement.
