Submersible Vessels and Related Articles

ITAR · Part 121 · § 121.1

Submarines, submersibles, uncrewed underwater vessels meeting USML criteria, and related articles. Effective 2026-10-19 (FR 2026-19211, 91 FR 59063–59065): (a)(9) anti-recovery (scuttle or self-destruct); (a)(10) uncrewed, untethered vessels of 3,000–8,000 lb specially designed for both endurance longer than 24 hours or range more than 70 nmi and navigation beyond fixed waypoints, station-keeping, or COLREGs-style avoidance (Note 1 to (a)(10)(ii)); (a)(11) uncrewed, untethered vessels exceeding 8,000 lb with that endurance/range test. Vessels that leave former (a)(10) and are not elsewhere on the USML are subject to the EAR. § 126.9(u) is unchanged and still keys to XX(a)(10), not (a)(11). eCFR § 121.1 reflects this rule from 2026-10-21 (the 10-19/10-20 display briefly showed old and new text; eCFR correction, 91 FR 59065). Do not invent ECCNs. Navigational aid — not legal advice.
