§ 748.4

Basic guidance related to applying for a license

EAR · Part 748

Who may apply for an EAR license and how the application must identify the transaction: (a) license applicant (U.S. exporter / principal party in interest; routed-export and reexport agents with written authorization); (b) disclosure of all parties and power of attorney; (c) persons prohibited from applying after specified convictions / denial orders; (d) prior action on a shipment (detention, seizure, or items already exported); plus multiple shipments, second applications, resubmission, and emergency processing. This is application guidance — not a license, not a classification, and not a way to authorize a transaction that is already prohibited.

  • Live eCFR title (as of 2026-09-14 compilation): Basic guidance related to applying for a license — not “Restrictions on applying for a license.”
  • (c) bars persons subject to a denial order based on a conviction for a statute specified at 50 U.S.C. 4819(e)(1)(B) from applying for a period up to 10 years from conviction. That is the prohibition-on-applying rule — not a restatement of General Prohibition 10 or Part 764.
  • Parties that must be disclosed include those in § 748.5. Entity List / § 744.16 screens against purchaser, intermediate consignee, ultimate consignee, and end-user (§ 748.5(c)–(f)), not bill-to alone.
  • Navigational aid — not legal advice. Filing in SNAP-R is official HTML only — no SNAP-R REST is claimed.
