BIS authority to impose Entity List license requirements, license-exception limits, and review policy for entities (or high-diversion-risk addresses) acting, or at significant risk of acting, contrary to U.S. national security or foreign policy interests. Listings are made on Supplement No. 4 with a reference to this section. License is required to the extent specified on the Entity List when a listed entity, or any entity using a high-diversion-risk address, is a party to the transaction under § 748.5(c)–(f). This section is listing criteria plus the “informed by BIS” prohibition — not a substitute for § 744.16 (Entity List license requirements, exceptions, review, ERC, removal, and § 744.16(f) addresses).

Stayed through Nov. 9, 2026 — § 744.11(a)(1) affiliate / 50% extension not currently authorized

At 90 FR 50857 (FR Doc. 2025-19846, published Nov. 12, 2025), BIS stayed 15 CFR § 744.11(a)(1) (Entity List entries extending to foreign affiliates owned 50 percent or more) effective until November 9, 2026 — the one-year suspension of the Affiliates Rule (90 FR 47201).
