§ 740.17

Encryption commodities, software, and technology (ENC)

EAR · Part 740

The encryption exception. 5A002 / 5D002 / 5E002 items that have been classified or self-classified as eligible, including mass-market 5A992/5D992 in many cases, may ship under ENC to most destinations, with reporting and a China/D:1/E carve-out that still surprises product teams.

Mass-market (740.17(b)(1)) is a defined test, not a marketing claim.
Non-mass-market 5A002 to Country Group D:1 or E still needs a license in many cases.
