§ 734.8

Fundamental research

EAR · Part 734

Basic and applied research in science and engineering at accredited U.S. institutions of higher learning where the resulting information is ordinarily published and shared broadly. University contract clauses that reserve publication approval, that bar foreign-person participation, or that classify the work will knock you out of this exclusion.

Deemed-export issues at a university usually begin with a side agreement the PI signed.
This is an information exclusion, not a hardware exclusion. A controlled spectrometer on campus is still a controlled spectrometer.
