§ 126.7

Exemptions for defense trade and cooperation among Australia, the United Kingdom, and the United States

ITAR · Part 126

The AUKUS license-free transfer exemption (effective 2024, as amended). Unclassified defense articles, technical data, and defense services may move among authorized users in Australia, the UK, and the United States without a license, except for items on the Excluded Technology List (Supplement No. 2 to Part 126) and other stated carve-outs. Membership of the country is not enough — the transferor and recipient must be eligible AUKUS users, and 126.1 / classified / ETL limits still apply.

  • AUKUS does not swallow the Australia and UK Defense Trade Cooperation Treaties (§§ 126.16–126.17); the instruments coexist.
  • The Excluded Technology List is the whole game. If it is on Supplement No. 2, this exemption does not apply.
