§ 123.22(b)(1)

EEI filing clocks — air/truck 8 hours, sea/rail 24 hours

ITAR · Part 123 · § 123.22

§ 123.22(b)(1). Before exporting hardware under a license or an exemption, the DDTC-registered exporter or agent must electronically file the export information with CBP at least 8 hours prior to departure for an air or truck shipment, and at least 24 hours prior to departure for a sea or rail shipment. Presentation of the articles and the required electronic documentation (including the ITN) to CBP is a separate, additional duty under this section — filing the EEI is not by itself the export. There is no 72-hour ITAR clock.

  • Air or truck: ≥ 8 hours before departure.
  • Sea or rail: ≥ 24 hours before departure.
  • FTR (15 CFR part 30) / EAR part 758 is a different statute. Label it FTR/EAR if you cite it at all.
