§ 123.22

Filing, retention, and return of export licenses and filing of export information

ITAR · Part 123

How a licensed or exempt hardware export is reported to CBP and how the license is decremented, retained, and returned. § 123.22(b)(1) is the ITAR EEI clock: file at least 8 hours before departure for air or truck, and at least 24 hours before departure for sea or rail, plus the presentation of the shipment and supporting documents (including the ITN) to CBP. There is no 72-hour rule in this section. Emergency air/truck filings live in (b)(2). Technical-data and agreement filings live in (b)(3). Census Foreign Trade Regulations (15 CFR 30.4) are FTR/EAR EEI rules, not ITAR.

  • Do not paraphrase a 72-hour AES clock. Live § 123.22(b)(1) is 8 hours (air/truck) and 24 hours (sea/rail) before departure.
  • An EEI citation to the wrong exemption is a § 127.2 misrepresentation even if some other exemption might have applied.
  • Port Directors (§ 120.69) and CBP/ICE (§ 127.4) own the dock. Open the live eCFR § 123.22 before you file.
  • FTR (15 CFR part 30) / EAR part 758, not an ITAR clock. Do not cite it as ITAR.
