§ 123.10

Nontransfer and use assurances

ITAR · Part 123

Exports of Significant Military Equipment, classified articles, and other designated items generally require a DSP-83 Nontransfer and Use Certificate executed by the foreign consignee and end-user (and, for SME, often the foreign government). The DSP-83 is the paper edge of § 120.17 end-use monitoring. Shipping SME without it is an unlicensed-adjacent failure.

  • FR 2026-19161: DSP-83 is not required when using the § 126.5 Canadian exemption. See § 123.10 / revised § 126.5(b) and (d).
