§ 120.4

Commodity jurisdiction

ITAR · Part 120 · Subpart A

The commodity jurisdiction (CJ) procedure is used if doubt exists as to whether an article or service is covered by the USML. A CJ determination is a formal agency decision on whether an item is ITAR-controlled. Submission mechanics live in § 120.12. A CJ is not a license and does not authorize any export.

  • File electronically via DECCS. Include technical descriptions, product literature, and a recommended jurisdiction.
  • A CJ finding that an item is EAR-controlled does not by itself classify the ECCN — that is a Commerce/SNAP-R or self-classification problem.
